Terms of Service - Beyond Detox
1. Agreement
This Services and Payment Agreement (“Agreement”) is made between Applied Recovery Co Pty Ltd (ABN 59 646 251 630) trading as Clean Slate Clinic (“Clean Slate Clinic”) and the individual agreeing to these terms (“Client”). This Agreement sets out the terms under which Clean Slate Clinic will provide its services to the Client, and the Client will pay for these services.
By agreeing to this document, the Client confirms acceptance of these Terms of Service, the Privacy Policy accessible here: Clean Slate Clinic Privacy Policy, and any required consents associated with the service. The Client acknowledges that proceeding into the Beyond Detox Program beyond the First Clinician Appointment (as described in Clause 2) constitutes a legally binding financial commitment to the full program fee. All fees stated in this Agreement are inclusive of GST where GST is applicable.
2. Payment Options
The Client agrees to pay for the Clean Slate Clinic program through one of the following options:
(a) One payment of $2,150; or
(b) Six monthly payments of $410 totalling $2,460 (“Monthly Payment Plan”).
(c) 13 fortnightly payments of $195 totalling $2,535 ("Fortnightly Payment Plan").
The first payment must be made before the First Clinician Appointment. For Payment Plan Clients, subsequent payments will be automatically charged each month to the nominated payment method. Failure to choose a payment option or to make the first payment before the First Clinician Appointment may result in delays or denial of services until the payment obligations are met.
First Clinician Appointment only
As an alternative, the Client may elect to attend the First Clinician Appointment only, for a fee of $195, without committing to the full Beyond Detox Program. If, following that appointment, the Client elects to continue into the full Program, the $195 already paid will be credited against the Program fee, and the Client must pay the balance under one of the following options:
(i) One payment of $1,955; or
(ii) 6 monthly payments of $377.50 totalling $2,265; or
(iii) 12 fortnightly payments of $195 totalling $2,340.
Payment of the first instalment (or the upfront balance, as applicable) constitutes acceptance of these Terms of Service in full. Financial commitment to the full Program fee attaches as set out in Clauses 5 and 7.
3. Program Description
The Clean Slate Clinic Beyond Detox Program consists of two phases:
Phase 1: Assessment: First Clinician Appointment, Second Clinician Appointment, and Medical Review (with either a Doctor or an Alcohol and Other Drug Nurse Practitioner), which includes discussion and prescribing of craving-reduction medication (where clinically appropriate).
Phase 2: Aftercare Support: Nine clinician reviews delivered over the remainder of the six months, together with unlimited access to SMART Recovery meetings and online resources.
On completion of Phase 2 (six months following program commencement) the Client will be discharged from the Clean Slate Clinic program. Additional services can be purchased during the program or thereafter.
4. Cost Breakdown
The Program fee covers two main cost components:
— Assessment (Phase 1): $1,050
— Aftercare (Phase 2): $1,100
Total Program fee: $2,150, payable under one of the options in Clause 2.
5. Payment Terms
The Program is a single integrated therapeutic program delivered across Phases 1–2 as described in Clause 3.
Phase 1 — Opt-out window. During Phase 1 (Assessment), the Client may elect to opt out of the Program. The amounts payable on opt-out during Phase 1 are set out in Clause 7. The Client is not committed to the full Program fee during this phase.
Phase 2 onwards — full commitment. By commencing Phase 2 (Aftercare), the Client commits to the full Program fee and is liable for the full fee regardless of early withdrawal or discharge, except where agreed in writing.
Clients may choose to pay the Program fee in full upfront or via a Monthly or Fortnightly Payment Plan. Choosing a Payment Plan does not convert the Program into a month-to-month or cancellable service. This structure enables Clean Slate Clinic to allocate appropriate clinical resources to support the Client throughout their recovery and ensure continuity of care.
Missed or cancelled appointments (with less than 24 hours' notice) are forfeited and non-refundable. Additional sessions may be purchased separately, if required.
6. Payment Authorisation
The Client authorises Clean Slate Clinic to deduct payments from the Client's nominated payment method in accordance with Clause 2 and any other amounts payable under this Agreement. The Client must ensure the nominated payment method remains valid and has sufficient funds available. If a payment method expires, is lost, or otherwise becomes invalid, it is the Client's responsibility to provide an updated payment method prior to the next scheduled or due payment.
7. Refunds and Cancellation Policy
The following refund and opt-out terms apply:
(a) Cancellation before the First Clinician Appointment If the Client cancels more than 24 hours before the First Clinician Appointment, they are eligible for a full refund of all amounts paid.
(b) Opt-out after the First Clinician Appointment If the Client attends the First Clinician Appointment and opts out within 48 hours and notifies Clean Slate Clinic of the opt-out in writing, the amount payable by the Client is $195. Any amounts paid by the Client in excess of $195 will be refunded.
(c) Opt-out after the Second Clinician Appointment (during Phase 1) If the Client proceeds to the Second Clinician Appointment (or the Medical Review within Phase 1) and subsequently opts out before commencing Phase 2, and notifies Clean Slate Clinic of the opt-out in writing during Phase 1, the amount payable by the Client is $1,050 (covering Phase 1 — Assessment). Any amounts paid by the Client in excess of $1,050 will be refunded. If the Client has paid less than $1,050 (for example, under a Payment Plan), the Client remains liable for the balance up to $1,050, which Clean Slate Clinic may charge to the Client's nominated payment method under Clause 6.
(d) Commencement of Phase 2 Once the Client commences Phase 2 (Aftercare), the full Program fee under Clause 2 becomes payable regardless of subsequent cancellation, withdrawal, or early discharge, except where agreed in writing or required by law.
General Refund Terms Refunds are available only in the circumstances outlined above or in exceptional circumstances as determined by Clean Slate Clinic management. Refunds will be processed within 14 business days to the original payment method. Administrative fees will not exceed $50. For the purposes of this clause, "services rendered" means any appointments conducted, care packages delivered, or assessments completed.
8. Obligations and Warranties
The Client agrees to pay the amounts payable under this Agreement, including the full Program fee where the Client proceeds beyond Phase 1 in accordance with Clause 5. The Client acknowledges that the Program is not a subscription service but a legally binding financial obligation.
Clean Slate Clinic warrants that all personnel delivering services are appropriately qualified, trained, and experienced in accordance with Australian healthcare regulations. Services will be provided with due care and in compliance with Clean Slate Clinic's Privacy Policy and clinical guidelines.
9. Consequences of Non-Payment and Discharge
Failure to meet payment obligations may result in:
(a) Suspension of services until overdue payments are resolved.
(b) Transfer to a collection agency for recovery, with reasonable recovery costs borne by the Client.
Clean Slate Clinic may also discharge the Client from the Program in either of the following circumstances:
(c) Non-engagement. The Client misses two or more scheduled appointments without notice (or has two or more late cancellations in succession), and does not re-engage following at least two documented follow-up attempts by Clean Slate Clinic.
(d) Conduct breach. The Client behaves in a manner that is abusive, threatening, or otherwise unreasonable towards Clean Slate Clinic staff, or materially breaches this Agreement.
Following discharge under (c) or (d), the Client remains liable for the Program fee in accordance with Clause 5. Discharge does not affect any amounts already due and payable, nor any of Clean Slate Clinic's rights under this Agreement.
10. Amendments
This Agreement may only be amended in writing, agreed by both parties.
11. Additional Appointments
Additional services beyond those included will be charged as follows:
Relapse Withdrawal Support: If a Client experiences a relapse during the Program and requires further medically supervised withdrawal support, this may be provided as a Relapse Withdrawal Support package comprising five 30-minute nursing reviews for a fee of $500. A prescriber appointment, if clinically required, is included in the rate above.
12. Liability, Governing Law & Jurisdiction
(a) This Agreement is governed by the laws of New South Wales (NSW).
(b) Disputes arising under this Agreement are subject to the exclusive jurisdiction of NSW courts.
(c) Clean Slate Clinic provides services on an ‘as is’ and ‘as available’ basis. While all reasonable efforts are made to deliver safe and effective clinical care, Clean Slate Clinic does not guarantee specific health outcomes.
(d) The Client acknowledges that telehealth services may be affected by technical failures outside Clean Slate Clinic’s control, and Clean Slate Clinic is not liable for service disruptions due to internet failures, software malfunctions, or third-party service interruptions.
(e) To the maximum extent permitted by law, Clean Slate Clinic’s liability for any claim, whether in contract, tort, or otherwise, is limited to the total amount paid by the Client for services rendered under this Agreement.
(f) Nothing in this Agreement is intended to limit the Client’s rights under the Australian Consumer Law. If any provision of this Agreement conflicts with a non-excludable right under Australian Consumer Law, the conflicting provision shall be read down to the minimum extent necessary to comply with the law.
(g) Formal notices under this Agreement must be delivered via email to the registered email address provided by the Client. Notices sent via email will be deemed received 24 hours after transmission unless a failure notification is received. The Client agrees to keep their contact details up to date and notify Clean Slate Clinic of any changes.
13. Important Client Acknowledgements and Agreement
(a) The Client acknowledges that the Program represents a significant financial commitment. Before agreeing, the Client should consider their financial situation and seek independent advice if needed. By agreeing, the Client confirms they understand and agree to these terms.
(b) By agreeing to this Agreement, the Client represents and warrants that they are over 18 years of age, they have the full right, power and authority to agree to and be bound by the terms of this Agreement, and to fully perform all of their obligations under this Agreement.
(c) By agreeing to this Agreement, the Client also acknowledges and agrees to Clean Slate Clinic’s Privacy Policy available here: Clean Slate Clinic Privacy Policy.
(d) The Client acknowledges that services provided under this Agreement are for their personal use only. The Client may not assign, transfer, or sublicense their rights under this Agreement or share Clean Slate Clinic’s program materials with third parties.
(e) If the Client is under guardianship or has an appointed public trustee, the guardian or trustee must agree to this Agreement on behalf of the Client. The guardian or trustee acknowledges they have the legal authority to enter into this Agreement, and confirms they are acting in the best interests of the Client. Clean Slate Clinic reserves the right to request documentation verifying the authority of any guardian or trustee prior to providing services.
(f) Person making payment: The person who agrees to this Agreement and makes payment is responsible for all amounts payable under this Agreement, regardless of whether they are the Client (the person receiving the services) or a third party paying on the Client's behalf (such as a parent, family member, or other supporter).
By agreeing to this Agreement, that person:
(i) accepts the terms set out in this Agreement;
(ii) is liable for all amounts payable, including the Program fee, additional appointments, Relapse Withdrawal Support, and any other charges;
(iii) authorises Clean Slate Clinic to charge their nominated payment method in accordance with Clauses 2, 6, 7, and 9; and
(iv) acknowledges that, where they are not the Client, clinical decisions and the delivery of services remain matters between Clean Slate Clinic and the Client, and that they have no entitlement to access the Client's clinical information without the Client's consent.
(g) Promotional discounts. The Client acknowledges that Clean Slate Clinic may from time to time offer promotional discounts on Program fees, including paired sign-up discounts (where two new Clients enrol together) and refer-a-friend discounts (offered to a new Client referred by another person). Any discount applies only to the new Client(s) enrolling at the time, is reflected in the Program fee payable under this Agreement, and continues to apply for the duration of that Client's enrolment regardless of any change in circumstances of any other Client. Where a Client enrolled under a promotional discount becomes entitled to a refund under Clause 7, the refund is calculated on the discounted price actually paid. Promotional discounts have no cash value and cannot be combined with any other discount unless expressly stated.
14. Data & Privacy
The Client acknowledges that Clean Slate Clinic may collect, store, and use personal information in accordance with its Privacy Policy. The Client agrees that, in the event of a breach of this Agreement, Clean Slate Clinic may disclose relevant personal and payment information to third-party payment processors for the purpose of enforcing payment obligations, addressing disputes, and recovering outstanding amounts. Such disclosures will be limited to what is strictly necessary to validate transactions, manage chargeback claims, or resolve financial disputes. Clean Slate Clinic will take reasonable steps to ensure any third party receiving the Client’s data complies with applicable privacy laws and maintains appropriate data security standards.
