Terms of Service for Compassionate Access Fund Clients
1. Agreement
This Services Agreement ("Agreement") is made between Applied Recovery Co Pty Ltd (ABN 59 646 251 630) trading as Clean Slate Clinic ("Clean Slate Clinic") and the individual agreeing to these terms ("Client"). This Agreement sets out the terms under which Clean Slate Clinic will provide its services to the Client through a funded place in the Clean Slate Compassionate Access Fund ("Fund"). The Fund is administered by Clean Slate Clinic and supported by philanthropic funders.
By agreeing to this document, the Client confirms acceptance of these Terms of Service, the Clean Slate Clinic Privacy Policy, and any required consents associated with the service. The Client acknowledges that this is a legally binding document.
2. The Compassionate Access Fund
(a) The Fund provides funded places in Clean Slate Clinic programs to people who cannot access public funding and could not otherwise afford treatment.
(b) Funded places are limited and are allocated against quarterly caps. An offer of a funded place is subject to availability at the time of the offer. Where no place is available, the Client may be offered a place in a later period.
(c) A funded place covers the Program fee for the Program the Client is enrolled in (Clause 5). The Client is not required to pay the Program fee. The Client is asked to make a Participant Contribution under Clause 6, which may be waived.
3. Eligibility
3.1 To receive a funded place, the Client must meet all of the following criteria:
(a) Clinically suitable and actively help-seeking. The Client has initiated contact with Clean Slate Clinic or accepted a referral, and has completed Clean Slate Clinic's suitability assessment.
(b) Financial hardship. The Client has provided evidence of financial hardship by either:
- (i) a current Commonwealth concession card (Health Care Card, Pensioner Concession Card or Low Income Health Care Card); or
- (ii) a written attestation from a caseworker, clinician, refuge, community legal service or other health professional confirming the Client's hardship where no concession card is yet held.
(c) One funded episode per person. The Client has not previously received a funded episode of care through the Fund. Repeat access is available only by exception.
3.2 The Client confirms that the information provided to establish eligibility is true and complete, and consents to Clean Slate Clinic verifying it, including by checking the concession card or contacting the professional who provided the attestation.
3.3 Clean Slate Clinic determines eligibility and will tell the Client the outcome. On request, Clean Slate Clinic will explain the reasons for its decision.
4. Changes in Circumstances
(a) Eligibility is assessed at enrolment. A change in the Client's financial circumstances after enrolment does not affect the Client's funded place, which continues for the duration of the Program.
(b) If Clean Slate Clinic reasonably determines that the Client's eligibility was established using information the Client knew to be false or misleading, Clean Slate Clinic may withdraw the funded place by written notice. The Client may then elect to continue in the Program as a privately paying client under Clean Slate Clinic's standard 12 Month Program Terms of Service, or to leave the Program. Clean Slate Clinic will not seek payment of the Program fee for services delivered before the date of that notice.
5. Program Description
5.1 The following programs are available through the Fund. The Client's Program is confirmed in their enrolment confirmation.
- Alcohol withdrawal and recovery — 12 months
- Cannabis withdrawal and recovery — 12 months
- Stimulant withdrawal and recovery — 12 months
- Beyond Detox support for post-detox clients — 6 months
5.2 12 Month Programs. Each 12 Month Program consists of three phases, delivered via one of two clinical pathways (Medicated or Non-Medicated) as determined under Clause 5.3.
Phase 1: Assessment & Pathway Determination. First Clinician Appointment, Second Clinician Appointment, and Medical Review. Care package (for Clients on the alcohol pathway), and preparation for the next phase of treatment, over approximately two weeks.
Phase 2: Acute Treatment. Five clinical reviews delivered according to the Client's clinical pathway:
- Medicated pathway: a structured period of medically supervised home-based withdrawal with daily nursing reviews, followed by a further Medical Review which includes discussion and prescribing of craving-reduction medication (where clinically appropriate).
- Non-Medicated pathway: five clinician transition reviews spaced over a longer period, supporting the Client's recovery without intensive medicated withdrawal.
Phase 3: Aftercare. Regular clinician reviews tapering from weekly to fortnightly to monthly over the remainder of the 12 months (nine reviews on the Medicated pathway, ten reviews on the Non-Medicated pathway), together with unlimited access to SMART Recovery meetings and online resources.
5.3 Clinical Pathway Determination. Following the First Clinician Appointment, the treating clinician will determine the appropriate clinical pathway for the Client (Medicated or Non-Medicated), based on the recommended treatment plan, having regard to the Client's clinical presentation and recovery needs. Both pathways are part of the same 12 Month Program, involve the same total number of clinical appointments, and are delivered under this Agreement. The Client acknowledges that the pathway is a clinical decision made in the Client's best interests by their treating clinician.
5.4 Beyond Detox (6 months). Each 6 Month Program consists of two phases.
Phase 1: Assessment & Pathway Determination. First Clinician Appointment, Second Clinician Appointment, and Medical Review including preparation for the next phase of treatment, over approximately two weeks.
Phase 2: Aftercare. Regular clinician reviews over the remainder of the 6 months (nine reviews), together with unlimited access to SMART Recovery meetings and online resources.
5.5 On completion of the Program (12 months, or 6 months for Beyond Detox, following program commencement) the Client will be discharged from the Clean Slate Clinic program. Additional services can be purchased thereafter.
6. Participant Contribution
(a) The Client is asked to contribute $50 per month for the duration of the Program ("Participant Contribution"): up to $600 in total for a 12 Month Program, or up to $300 for Beyond Detox.
(b) The Participant Contribution is a partial payment towards the cost of the clinical services delivered to the Client under this Agreement. The balance of the cost is met by philanthropic funding held in the Fund. The clinical services delivered under this Agreement are GST-free supplies of medical services under section 38-7 of the A New Tax System (Goods and Services Tax) Act 1999. No GST is payable on the Participant Contribution.
(c) The first Participant Contribution is payable before the First Clinician Appointment. Subsequent contributions will be automatically charged each month to the nominated payment method.
(d) Waiver. The Participant Contribution may be waived in full or in part where Clean Slate Clinic determines that it would otherwise prevent the Client from starting or continuing treatment. The Client may request a waiver at enrolment or at any time during the Program by contacting Clean Slate Clinic. Waiver requests are handled confidentially and do not affect the Client's clinical care.
(e) Missed contributions. If a Participant Contribution is not paid, Clean Slate Clinic will contact the Client to discuss it, including whether a waiver is appropriate. Clean Slate Clinic will not suspend services because of a missed Participant Contribution without first offering a waiver review, and will not refer unpaid Participant Contributions to a collection agency.
7. Payment Authorisation
The Client authorises Clean Slate Clinic to deduct the Participant Contribution from their nominated payment method in accordance with Clause 6. The Client should ensure the payment method remains valid, and may update it or request that deductions stop (for example, following a waiver) by contacting Clean Slate Clinic.
8. Cancellation, Withdrawal and Refunds
(a) Before the First Clinician Appointment. If the Client cancels more than 24 hours before the First Clinician Appointment, any Participant Contribution paid will be refunded in full.
(b) Withdrawal from the Program. The Client may withdraw from the Program at any time by notifying Clean Slate Clinic in writing. The Client is not liable for any part of the Program fee, which is met by the Fund. Participant Contributions for months already commenced are non-refundable. Any Participant Contribution charged for a month that begins after the Client's withdrawal notice will be refunded.
(c) Missed appointments. If the Client cancels an appointment less than 24 hours before the appointment time or does not attend an appointment, the appointment is forfeit.
Refunds will be processed within 14 business days to the original payment method.
9. Discharge
Clean Slate Clinic may discharge the Client from the Program in any of the following circumstances:
(a) Non-engagement. The Client misses two or more scheduled appointments without notice (or has two or more late cancellations in succession), and does not re-engage following at least two documented follow-up attempts by Clean Slate Clinic.
(b) Conduct breach. The Client behaves in a manner that is abusive, threatening, or otherwise unreasonable towards Clean Slate Clinic staff, or materially breaches this Agreement.
(c) Clinical suitability. The treating clinician determines that the Program is no longer clinically appropriate for the Client. Where this occurs, Clean Slate Clinic will support the Client with a referral to a more appropriate service where possible.
Following discharge, the Client is not liable for the Program fee, and no further Participant Contributions will be charged. Participant Contributions already paid are non-refundable.
10. Additional Services
(a) Services beyond those included in the Program are not automatically covered by the funded place.
(b) Where additional services are clinically required, including Relapse Withdrawal Support (five 30-minute nursing reviews and, if clinically required, a prescriber appointment), Clean Slate Clinic may, at its discretion, fund them from the Fund.
(c) Additional services not funded under (b) are charged at Clean Slate Clinic's standard rates, and only with the Client's prior written agreement:
- 60-minute nurse appointment — $195
- 30-minute nurse appointment — $100
- 60-minute prescriber appointment — $410
- 30-minute prescriber appointment — $210
- 60-minute addiction medicine specialist appointment — $490
- Clean Slate Conversations (SMART Recovery) monthly access — $55
- Relapse Withdrawal Support — $500
11. Obligations and Warranties
(a) Clean Slate Clinic warrants that all personnel delivering services are appropriately qualified, trained, and experienced in accordance with Australian healthcare regulations. Services will be provided with due care and in compliance with Clean Slate Clinic's Privacy Policy and clinical guidelines.
(b) The Client agrees to provide accurate information, to attend scheduled appointments or give at least 24 hours' notice of cancellation, and to keep their contact details up to date.
(c) Safe contact. The Client may nominate how and when Clean Slate Clinic may safely contact them (for example, a specific phone number, email address or time of day, or no voicemail). Clean Slate Clinic will use only the nominated safe contact methods.
12. Amendments
This Agreement may only be amended in writing, agreed by both parties.
13. Liability, Governing Law & Jurisdiction
(a) This Agreement is governed by the laws of New South Wales (NSW).
(b) Disputes arising under this Agreement are subject to the exclusive jurisdiction of NSW courts.
(c) Clean Slate Clinic provides services on an 'as is' and 'as available' basis. While all reasonable efforts are made to deliver safe and effective clinical care, Clean Slate Clinic does not guarantee specific health outcomes.
(d) The Client acknowledges that telehealth services may be affected by technical failures outside Clean Slate Clinic's control, and Clean Slate Clinic is not liable for service disruptions due to internet failures, software malfunctions, or third-party service interruptions.
(e) To the maximum extent permitted by law, Clean Slate Clinic's liability for any claim, whether in contract, tort, or otherwise, is limited to the total amount paid for services rendered under this Agreement (whether by the Client or the Fund).
(f) Nothing in this Agreement is intended to limit the Client's rights under the Australian Consumer Law. If any provision of this Agreement conflicts with a non-excludable right under Australian Consumer Law, the conflicting provision shall be read down to the minimum extent necessary to comply with the law.
(g) Formal notices under this Agreement must be delivered via email to the registered email address provided by the Client, or by another safe contact method nominated under Clause 11(c). Notices sent via email will be deemed received 24 hours after transmission unless a failure notification is received.
14. Important Client Acknowledgements and Agreement
(a) By agreeing to this Agreement, the Client represents and warrants that they are over 18 years of age, and that they have the full right, power and authority to agree to and be bound by the terms of this Agreement and to perform their obligations under it.
(b) By agreeing to this Agreement, the Client also acknowledges and agrees to Clean Slate Clinic's Privacy Policy.
(c) The Client acknowledges that services provided under this Agreement are for their personal use only. The Client may not assign, transfer, or sublicense their rights under this Agreement or share Clean Slate Clinic's program materials with third parties. A funded place cannot be transferred to another person.
(d) If the Client is under guardianship or has an appointed public trustee, the guardian or trustee must agree to this Agreement on behalf of the Client. The guardian or trustee acknowledges they have the legal authority to enter into this Agreement, and confirms they are acting in the best interests of the Client. Clean Slate Clinic reserves the right to request documentation verifying the authority of any guardian or trustee prior to providing services.
(e) Person paying the Participant Contribution. Where a third party (such as a family member or support service) pays the Participant Contribution on the Client's behalf, that person authorises Clean Slate Clinic to charge their nominated payment method under Clauses 6 and 7, and acknowledges that clinical decisions and the delivery of services remain matters between Clean Slate Clinic and the Client, and that they have no entitlement to access the Client's clinical information without the Client's consent.
15. Data & Privacy
(a) The Client acknowledges that Clean Slate Clinic may collect, store, and use personal information in accordance with its Privacy Policy.
(b) Eligibility information. Concession card details and hardship attestations are collected and used only to assess and verify eligibility for the Fund. They are stored securely with access restricted to staff who need them for that purpose.
(c) Reporting to funders. Clean Slate Clinic reports on the Fund's performance to its philanthropic funders. These reports contain de-identified, aggregated information only, such as the number of places filled, referral sources, Participant Contribution and waiver rates, and clinical outcomes. Clean Slate Clinic will not disclose information that identifies the Client to a funder without the Client's express consent.
(d) Referring services. Where the Client was referred by another service (for example, a caseworker, health service or refuge), Clean Slate Clinic will share information about the Client's treatment with that service only with the Client's consent, which the Client may give or withdraw at any time.
(e) Clean Slate Clinic will take reasonable steps to ensure any third party receiving the Client's data complies with applicable privacy laws and maintains appropriate data security standards.
